1. Agreement
These Terms of Use are an agreement between you and gaming.tools, an eenmanszaak registered in the Netherlands under KVK number 84672056. They apply to companion.gaming.tools, the gaming.tools Companion for Windows, Companion web content, accounts, cloud features, updates, and related services, together called the Services.
By downloading, installing, accessing, or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not install or use the Services.
2. Eligibility and accounts
You must be at least 16 years old and legally able to enter this agreement. If local law requires a higher age or parental authorization, that rule applies.
You may sign in through a supported third-party provider. You are responsible for securing that provider account and for activity performed through your gaming.tools session. Do not sell, transfer, or share access to an account or entitlement. Tell us promptly at privacy@gaming.tools if you believe an account has been compromised.
3. License to the Companion
Subject to these Terms, gaming.tools grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Companion on Windows devices you control for personal, non-commercial use with supported games.
This license does not transfer ownership of the Companion, Services, code, branding, data, or content. Open-source components remain governed by their applicable licenses.
4. How the Companion works
To provide live tools, the Companion may inspect supported game processes, memory, local logs, files, and runtime state. It may display overlays, maps, session information, inventory state, progression, or other game-specific information. Some features run locally and others use gaming.tools cloud services.
Games and their technical interfaces change without notice. We do not promise that every feature will always be available, accurate, compatible with every system, or accepted by every game publisher or server operator. You are responsible for checking and following the rules that apply to your game account, server, tournament, or platform.
5. Acceptable use
You must not:
- Use the Services unlawfully, harmfully, fraudulently, or to violate another person's rights.
- Use the Services to cheat, disrupt multiplayer services, evade game enforcement, or violate applicable game or platform terms.
- Probe, attack, overload, interfere with, or bypass security, rate limits, access controls, advertising, or entitlement checks.
- Use automated requests, scrapers, bots, or scripts against the Services without written permission.
- Reverse engineer, decompile, or attempt to extract non-public source code, protocols, credentials, or data, except where applicable law expressly permits it.
- Redistribute, sublicense, resell, impersonate, or present the Companion or gaming.tools content as your own.
- Upload malware or content that is unlawful, infringing, abusive, or designed to compromise another user or system.
6. Cloud data and user submissions
You retain your rights in information you submit or sync. You grant gaming.tools a limited license to host, process, reproduce, and transmit that information only as needed to operate, secure, and improve the Services and meet legal obligations.
You are responsible for information you choose to submit and must have the right to provide it. The Services are not intended as a backup service. Keep your own copies of information you cannot afford to lose.
7. Advertising and premium benefits
Free use may include advertising. An eligible Patreon membership or another entitlement recognized by gaming.tools may remove Companion advertisements or unlock other benefits while that entitlement remains active.
Patreon handles subscription checkout, billing, cancellation, and refunds under Patreon's terms and applicable consumer law. gaming.tools does not receive your complete payment-card details. Premium features, plan names, and benefits may change with reasonable notice, but mandatory consumer rights remain unaffected.
8. Updates and service changes
The Companion may check for updates and offer a newer version. Updates may add, modify, or remove features and may be required for continued compatibility or security. We may change, suspend, retire, or limit a Service when reasonably necessary, including for security, legal, provider, game compatibility, or operational reasons.
9. Intellectual property and feedback
gaming.tools and the Companion design, software, original content, databases, and branding are owned by gaming.tools or its licensors and are protected by applicable intellectual-property laws. Permission to use the Services does not grant permission to reuse those assets outside the Services.
If you voluntarily provide an idea or suggestion, you allow gaming.tools to use it without restriction or payment. This does not transfer ownership of your existing intellectual property.
10. Third-party games and services
Game names, artwork, assets, trademarks, and other game intellectual property belong to their respective owners. The Companion is a fan-made service and is not endorsed by or affiliated with the publishers of Dune: Awakening, Palia, Palworld, or other supported games unless explicitly stated.
Links, downloads, authentication, billing, advertising, and other third-party services are governed by the third party's terms. gaming.tools is not responsible for a third party's service, content, security, availability, or decisions.
11. Suspension and termination
You may stop using the Services at any time and may request account deletion. We may suspend or terminate access where reasonably necessary to investigate abuse, protect users or systems, comply with law, or address a material or repeated breach of these Terms. Where practical, we will provide notice and an opportunity to resolve the issue.
Terms that by their nature should survive termination, including ownership, disclaimers, liability limitations, and dispute provisions, continue to apply.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, gaming.tools disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
We do not guarantee the accuracy of live game data, that the Companion will not conflict with another program, or that use will not affect a game account. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, gaming.tools is not liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, gameplay, accounts, opportunities, goodwill, or data arising from the Services. You remain responsible for backups, system security, and compliance with game rules.
Nothing limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or another liability that applicable law does not allow to be limited.
14. Governing law and disputes
These Terms are governed by Dutch law. Courts in the Netherlands have jurisdiction, except where mandatory consumer law gives you the right to bring or defend a claim in another place or under another law. Please contact us first so we can try to resolve a concern informally.
15. Changes and contact
We may update these Terms to reflect changes to the Services or law. Material changes will be communicated through the site, Companion, or another appropriate channel. Continued use after updated Terms take effect means you accept them where permitted by law.
